These Policies (hereinafter, the “Policies”) condition the use of the services of the Internet portal http://www.licormart.net (hereinafter, the “Portal”) of LICORMART DRINK SMART, and ALMACENES GALERÍAS DEL SUR, SRL (hereinafter, “Licormart”).

Terms & Conditions

Minors.-

To enter Licormart's portal and enjoy our services, Users must be at least 18 years old.

Obligation to use the Portal and its Services appropriately.-

1. User agrees to utilize the Portal and its Services in compliance with the law, these Policies, the Terms of Use, any Specific Conditions for particular Services, and any other notifications or instructions provided, while also adhering to public order, moral standards, and commonly accepted norms of behavior.
2. User is prohibited from acquiring or attempting to acquire the Content through means or methods other than those expressly provided or indicated on the web pages where the content is found, or those commonly used on the Internet, provided they do not pose a risk of harming or disabling the Portal, the Services, and/or the content.

All trademarks, trade names, or other distinctive symbols featured on the Portal belong to Licormart or third parties. The use or access to the Portal and/or Services does not confer any rights to the User over these aforementioned distinctive signs.

Similarly, the Contents are the intellectual property of Licormart or third parties. By these Policies, no exploitation rights over such contents are transferred to the User beyond what is strictly necessary for the proper use of the Portal and Services. Therefore, the User may only consult, copy, and store the material available on this website on their computer's hard drive or any other physical medium, or print or reproduce it, strictly for personal or private use, or within their company or organization, provided that Licormart's ownership is acknowledged at all times. Any alteration, modification, or decompilation of the content is strictly prohibited.

Commercializing the material contained on this site in any form or under any title is strictly prohibited without prior written authorization from Licormart. This portal may contain information from other sources, and in such cases, their consent must be obtained for reproduction.

Exclusion of Warranties and Liabilities

1. Availability and Continuity, Utility, and Reliability.- Licormart does not guarantee the availability and continuity of the Portal and Services operation. Whenever possible, Licormart will provide advance notice of interruptions in Portal and Services operation. Licormart does not guarantee the usefulness of the Portal and Services for any specific activity, nor their infallibility. Specifically, but not exclusively, Licormart does not guarantee that the User can effectively utilize the Portal and Services, access the various web pages comprising the Portal, or those providing the Services.

LICORMART DISCLAIMS ANY LIABILITY FOR DAMAGES OF ANY NATURE RESULTING FROM THE UNAVAILABILITY OR DISCONTINUITY OF PORTAL AND SERVICES OPERATION, THE FAILURE TO MEET THE UTILITY EXPECTATIONS ATTRIBUTED TO THE PORTAL AND/OR SERVICES, THE FALLIBILITY OF THE PORTAL AND/OR SERVICES, AND SPECIFICALLY, BUT NOT EXCLUSIVELY, FAILURES IN ACCESSING VARIOUS WEB PAGES OF THE PORTAL OR THOSE PROVIDING THE SERVICES.

2. Privacy and Security in Portal and Services Usage.- Licormart does not ensure the privacy and security of Portal and Services usage. Specifically, Licormart does not guarantee that unauthorized third parties cannot gain knowledge of the type, conditions, characteristics, and circumstances of the User's Portal and Services usage.
3. Quality.- Licormart does not oversee or warrant the absence of viruses or other elements in the Content that may cause alterations in your computer system (software and hardware) or in the electronic documents and files stored in your computer system.
4. Truthfulness, Accuracy, and Timeliness.- LICORMART DISCLAIMS ANY RESPONSIBILITY FOR DAMAGES AND LOSSES OF ANY NATURE THAT MAY ARISE FROM THE LACK OF TRUTHFULNESS, ACCURACY, AND/OR TIMELINESS OF THE CONTENTS.
5. Legality, reliability, and usefulness.- Licormart does not guarantee the legality, reliability and usefulness of the services provided by third parties through the Portal.

LICORMART EXCLUDES ANY RESPONSIBILITY FOR DAMAGES AND LOSSES OF ANY NATURE THAT MAY ARISE FROM THE SERVICES PROVIDED BY THIRD PARTIES THROUGH THE PORTAL.

Procedure for Addressing Illegal Activities

If any User or third party believes there are facts or circumstances indicating the illicit nature of the use of any content and/or the performance of any activity on the Web pages included or accessible through the Portal, particularly the violation of intellectual property rights or other rights, they must notify Licormart with the following information:

1. Personal data of the claimant: name, ID number (or passport, in the case of foreigners), address, telephone number and email address;
2. Specification of the alleged illegal activity conducted on the Portal and, in particular, when it involves an alleged violation of rights, precise and concrete indication of the protected content as well as its location on the Web pages;
3. Facts or circumstances that reveal the illicit nature of said activity;
4. In the event of violation of rights, a handwritten signature or equivalent, with the Personal Data of the owner of the rights allegedly infringed or of the person authorized to act in their name and on their behalf;
5. Express, clear declaration under the responsibility of the claimant that the information provided in the notification is accurate and of the illegal nature of the use of the content or the performance of the activities described.

Notifications

All notifications and communications (hereinafter, the “Notifications”) by the User to Licormart will be considered effective, for all purposes, when sent to us by courier.

Applicable Legislation

These Policies are governed in each and every one of their parts by the laws of the Dominican Republic.

Jurisdiction
